1. Introduction
These Terms govern your access to and use of services provided by Magic Yantra (referred to as "we", "us", or "the Company"). By using our platforms, APIs, dashboards, apps or services (collectively "Services"), you agree to these Terms.
2. Eligibility & Account
- Users must be 18+ and able to form binding contracts under applicable law.
- Accounts require accurate KYC details (name, mobile, PAN, Aadhaar where applicable) when requested for AEPS or settlement purposes.
- You are responsible for keeping credentials confidential; you accept liability for actions performed via your account unless caused by our gross negligence.
3. Services & Service Levels
We provide AEPS, DTM, Recharge, IRCTC agent onboarding, flight & bus booking, bill payments and M-ATM services. Third-party providers (banks, operator aggregators, IRCTC, airlines, bus operators) may be involved in fulfilling certain transactions.
SLA & uptime: We target 99.9% platform availability; however, outages caused by third parties, force majeure or maintenance windows are excluded.
4. Fees, Billing & Settlement
- Fees, commissions and taxes are disclosed during transaction flows. You agree to pay applicable fees.
- Settlements to agent accounts follow the schedule agreed during onboarding. We may hold funds for anti-fraud verification and regulatory compliance.
- Refunds for failed third-party transactions are processed after confirmation — timeline varies per provider (24–15 working days is typical for some banking reversals).
5. User Responsibilities & Prohibited Conduct
Users must not:
- Use Services for illegal activity, money-laundering, or terror financing.
- Attempt to access other accounts, exploit APIs, or manipulate transaction payloads.
- Share account credentials or resell access unless explicitly authorized.
6. KYC, Compliance & Data
We may require KYC for certain products (AEPS, higher value settlements). You consent to provide required documents and to verification checks. We will share KYC with regulators or partners when legally required.
7. Privacy
Use of personal data is governed by our Privacy Policy. By using Services, you consent to that policy.
8. Limitation of Liability & Indemnity
To the fullest extent permitted by law, Magic Yantra's liability for direct damages will be limited to the amount paid to us for the specific transaction in dispute during the prior 12 months. We are not liable for indirect, incidental, punitive or consequential damages.
You agree to indemnify and hold us harmless from claims arising from your misuse of Services, breaches of these Terms, fraudulent activity or inaccurate information.
9. Dispute Resolution, Chargebacks & Refunds
- Raise transaction disputes via Support with transaction ID, timestamps and screenshots where applicable.
- We will adjudicate using provider logs. Typical resolution timelines: 24–72 hours for operator confirmations, 7–30 days for banking reversals depending on partners.
- Chargebacks initiated by banks or users may be investigated; if found fraudulent, we reserve recovery and compensation rights.
10. Intellectual Property & DMCA
All IP on the platform belongs to Magic Yantra or licensors. If you believe your copyright is infringed, provide a written notice per applicable law and include: identification, infringing URL, declaration and contact details.
11. Suspension & Termination
We may suspend/terminate accounts for fraud, regulatory requirements or material breach. On termination, outstanding liabilities remain payable and we may retain data for legal/regulatory purposes.
12. Changes to Terms
We may update these Terms; material changes will be notified. Continued use after update constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India and disputes shall be submitted to courts in the company's registered jurisdiction unless otherwise agreed.
